The owner of the online shop diamodo.com (hereinafter "the Shop") is Diamodo OÜ, registered in the Estonian Commercial Register (registry code: 17480441), located at Kaupmehe 7-117, Tallinn, Estonia. Contacts.
These terms of sale apply to all purchases made through diamodo.com. By placing an order, the buyer agrees to these terms.
Prices and product information
All prices are displayed in euros (EUR) and include VAT and delivery fee. Product descriptions, images, and specifications are provided next to each item. The Shop reserves the right to correct obvious pricing errors.
Placing an order
To place an order, select the desired item and complete the order form with the required details, including your preferred delivery method. Once the order is confirmed by the Shop via email, the sales contract enters into force. The item is reserved for the seller for 3 days, after which the reservation expires.
Payment
Payment can be made after receiving the goods, based on an invoice issued by the Shop. The invoice is sent immediately after the order confirmation. The buyer must pay the invoice before or upon receiving the item from the courier. The Shop retains ownership of the goods until full payment is received.
If it is not possible to fulfil the order due to lack of stock or another reason, the buyer will be notified promptly and no invoice will be issued.
Right of withdrawal
In accordance with the Estonian Law of Obligations Act (VÕS § 56) and EU Directive 2011/83/EU, the buyer (an individual) has the right to withdraw from the contract within 14 days of receiving the goods, without providing a reason.
To exercise this right, the buyer must notify the Shop in writing (e.g. by filling the contacts form) before the 14-day period expires. The buyer must return the goods within 14 days of sending the withdrawal notice. The cost of returning the goods is borne by the buyer.
The goods must be returned in their original condition and packaging without any post-sale modifications to the item. The seller may inspect the item in the same manner as would be permitted in a physical shop. If the value of the goods has decreased due to handling beyond what is necessary, the Shop may reduce the refund accordingly.
The right of withdrawal does not apply to custom-made or personalised items (VÕS § 53 lg 4 p 1).
Refunds
Upon valid withdrawal, the Shop will refund all amounts paid by the buyer within 14 days of receiving the returned goods and checking for their authenticity. If the buyer has not yet paid the invoice, it will be cancelled.
The right of withdrawal does not apply to business entities.
Warranty
You may contact the Shop regarding non-conformity of the goods with the contract within 2 years of purchase. Complaints regarding the quality of goods are considered only upon presentation of a document confirming the purchase.
How to file a complaint
To file a complaint regarding non-conformity, contact the Shop via Contacts within 30 days of discovering the defect. Please include your order details, a description of the issue, and photographs if possible.
In the event of non-conformity of the goods with the contract, the buyer is entitled to initially require the Shop to remedy the defects free of charge or to replace the goods, provided that such requirements are proportionate and do not entail disproportionate costs for the Shop.
The Shop carries out free repair or replacement of goods taking into account the nature of the item and the purposes of its use. The timeframe for remedying defects is determined individually in each specific case based on the nature of the defect identified.
Warranty service is not provided in the following cases:
- if the damage to the goods is intentional;
- if the established rules of operation and care for jewellery have not been observed;
- for items with rhodium plating and gold-plated jewellery, natural wear occurring during use is not recognised as a product defect and is not subject to warranty service;
- for jewellery items with precious stones, as well as items that have undergone resizing, exchange and return are not carried out, except in cases where a hidden manufacturing defect is identified that cannot be remedied by repair.
Refunds
If the Shop does not remedy the non-conformity within a reasonable time or does not replace the goods, the buyer is entitled to demand a proportionate reduction of the purchase price or cancellation of the contract with a refund of the amount paid.
The degree of wear of the goods may be taken into account when refunding or reducing the price.
Demands for cancellation and refund shall not be satisfied if the non-conformity is minor and does not significantly affect the functional or consumer properties of the goods, and can be remedied without substantially altering the appearance of the item.
The goods shall not be deemed non-conforming if, at the time of purchase, the buyer was informed of the defects or could not have been unaware of them (including discounted goods sold with known defects).
Refunds shall not be made in cases of damage caused by:
- intentional acts or negligence of the buyer;
- violation of the rules of operation and care;
- use of the goods for unintended purposes, including exposure to chemicals, open fire, high temperatures or sharp objects.
Dispute resolution
If a dispute cannot be resolved by agreement, the buyer may file a complaint with the Consumer Disputes Committee (Tarbijavaidluste komisjon, https://komisjon.ee). The buyer may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
These terms are governed by the laws of the Republic of Estonia.
